GDPR and Investment Migration: What Applicants Should Know About Their Data Rights

Investment migration applications involve the collection and processing of highly sensitive personal and financial data. Passports, bank statements, source of funds documentation, criminal records, and due diligence reports all pass through multiple hands during the application process. For applicants based in or connected to the European Union, the General Data Protection Regulation (GDPR) provides important rights that are often overlooked.

What Data Is Collected in an Investment Migration Application

A typical investment migration application involves the collection of identity documents (passports, national identity cards), proof of address, bank statements and financial records, source of wealth and source of funds documentation, criminal record certificates, professional references, and due diligence reports prepared by third-party investigators.

This data is processed by multiple parties: the advisory firm, the licensed agent in the destination country, the government authority processing the application, and potentially third-party due diligence providers. Each of these parties has obligations under applicable data protection law.

Your Rights Under GDPR

If you are an EU resident or if your data is processed by an EU-based organisation, GDPR applies to your application data. Your key rights include: the right to access your personal data held by any processor; the right to rectification of inaccurate data; the right to erasure (the 'right to be forgotten') in certain circumstances; and the right to data portability.

You also have the right to object to processing and the right to restrict processing in certain circumstances. If you believe your data has been processed unlawfully, you have the right to lodge a complaint with your national data protection authority.

Data Retention and the Application Process

One area of particular concern for investment migration applicants is data retention. Government authorities in destination countries may retain application data for extended periods — sometimes indefinitely — for anti-money laundering and national security purposes. This retention is generally lawful under GDPR's public interest exemption, but applicants should be aware that their data may be held long after their application is concluded.

Advisory firms and licensed agents are subject to stricter retention limits. Under GDPR, personal data should not be retained for longer than necessary for the purpose for which it was collected. Applicants should ask their adviser about their data retention policy before submitting documents.

Cross-Border Data Transfers

Investment migration applications inherently involve cross-border data transfers — your personal data will be sent to the destination country's government authority, which may be outside the EU. GDPR restricts transfers of personal data to countries that do not provide an adequate level of data protection.

In practice, most investment migration destination countries are not covered by EU adequacy decisions. Data transfers to these countries must be covered by appropriate safeguards, such as standard contractual clauses. Applicants should ask their adviser how cross-border transfers are handled and what safeguards are in place.
